Wildfire Affiliate Program Terms of Service
1. Agreement
By signing up as an Affiliate in the Wildfire Affiliate Program (“Program”), you agree to these terms and conditions (“Terms of Service”). Wildfire Oil reserves the right to update or change these terms at any time without prior notice. Continued participation in the Program constitutes your consent to such changes.
Violation of these terms may result in termination of your account and forfeiture of outstanding affiliate commissions. Use the Program at your own risk.
2. Summary

3. Account Terms
- You must be 18 years or older to join the Program.
- Participation is open to residents of Australia and other approved countries.
- Bots or automated account registrations are prohibited.
- Logins must be used by a single individual and not shared.
- Accurate information, including your legal name and email address, must be provided during signup.
- You are responsible for maintaining the security of your account and password.
- Affiliates may not hold multiple accounts or earn commissions by purchasing through their own links.
- Compliance with all applicable laws, including copyright and anti-spam laws, is required.
4. Links and Graphics
- Upon approval, you will receive a unique Affiliate Code.
- Use only the banners, links, and graphics provided by Wildfire Oil.
- Ensure all affiliate links (“Special Links”) use the correct tracking format for accurate commission tracking.
- Links should direct customers to the specific product page being promoted.
- Wildfire Oil is not liable for commissions lost due to incorrect link usage.
5. Referral Fees and Payment
- Commissions are earned when a customer completes a purchase through your Special Link during the same session.
- Payments are only made for tracked and recorded sales.
- The minimum payout threshold is $50. Earnings below this threshold will roll over to the next month.
- Commissions earned through fraudulent or unethical practices will be disqualified.
- Wildfire Oil reserves the right to adjust commission rates with prior written notice.
6. Identifying Yourself as a Wildfire Affiliate
- Affiliates may not issue press releases without approval.
- Affiliates must not misrepresent their relationship with Wildfire Oil.
- Purchasing products through your affiliate links for personal use is prohibited and may result in forfeited commissions.
7. Payment Schedule
- Payments are processed monthly for accounts exceeding the $50 threshold.
- Commissions are paid via [specific payment method(s)], and it is your responsibility to provide accurate payment details.
- Wildfire Oil is not liable for failed payments due to incorrect information.
8. Customer Definition
- Customers referred through the Program are deemed Wildfire Oil customers.
- Wildfire Oil retains the right to adjust pricing and policies at any time.
- Affiliates should avoid displaying product prices, as prices may change.
9. Affiliate Responsibilities
As an Affiliate, you are solely responsible for:
- Operating and maintaining your website or marketing channels.
- Ensuring compliance with third-party hosting agreements.
- Posting accurate and lawful content.
- Disclosing data collection practices in accordance with privacy laws.
- Maintaining up-to-date account information, including contact details, so Wildfire Oil can reach you as needed. This ensures compliance with the Terms and Conditions and prevents accidental breaches. Failure to update account information may result in account suspension or termination.
10. Compliance with Laws
Adherence to Australian Laws: Affiliates must comply with all applicable Australian laws and regulations, including but not limited to:
Australian Consumer Law (ACL): Prohibits misleading or deceptive conduct and mandates transparent disclosure of affiliate relationships.
Legal123Spam Act 2003: Regulates commercial electronic messages, requiring consent before sending marketing communications.
Acuity MagazinePrivacy Act 1988: Governs the handling of personal information, ensuring data is collected and used lawfully.
Queensland-Specific Regulations: As Wildfire Oil operates in Queensland, affiliates must also adhere to state-specific laws, including:
Fair Trading Act 1989 (Queensland): Aligns with the ACL, emphasizing fair trading practices within the state.
Queensland LegislationLocal Advertising Standards: Ensures all promotional materials meet Queensland's advertising guidelines.
International Affiliates: Affiliates operating outside Australia must comply with their local laws. However, in matters related to the Program, Australian law prevails, and affiliates agree to adhere to its provisions.
Legal Hierarchy: In case of any conflict between local (non-Australian) laws and Australian laws concerning the Program, Australian law will take precedence.
Ongoing Compliance: Affiliates are responsible for staying informed about and complying with any changes in relevant laws and regulations.
11. Term and Termination
- This Agreement begins upon acceptance into the Program and continues until terminated by either party.
- Either party may terminate this Agreement at any time with written notice.
- If you breach any of the terms outlined in this Agreement, Wildfire Oil reserves the right to terminate your account immediately. Upon termination for breach, all earned commissions, including those exceeding the $50 payout threshold, will be forfeited.
- Upon termination, you must immediately cease use of and remove all Special Links, promotional materials, trademarks, and other Wildfire Oil branding from your marketing channels.
12. Relationship of Parties
Affiliates and Wildfire Oil are independent contractors. This Agreement does not create a partnership, joint venture, or employment relationship.
13. Limitations of Liability
Wildfire Oil is not liable for indirect or consequential damages, including lost revenue or profits. Total liability is limited to the referral fees paid to you under this Agreement.
14. Disclaimers
- Wildfire Oil makes no warranties regarding the Program or its products.
- Wildfire Oil is not liable for interruptions or errors in the Program’s operation.
15. Arbitration
Disputes arising from this Agreement will be resolved through confidential arbitration under the rules of The Australian Centre for International Commercial Arbitration (ACICA). Exceptions apply for intellectual property disputes.
16. Intellectual Property
Affiliates may only use Wildfire Oil’s trademarks, logos, and promotional materials as provided. Unauthorised use, modification, or distribution is prohibited. Wildfire retains all intellectual property rights.
17. Unpaid Commissions Upon Termination
If your account is terminated for reasons other than a breach of these terms, Wildfire will pay any outstanding commissions exceeding the $50 threshold. Commissions below the threshold will be forfeited.

19. Changes to Terms
The current Terms of Service will be available on the affiliate dashboard. Affiliates will be notified of significant changes via email or account notifications.
20. Use of Artwork and Product Images
- Affiliates must use only the promotional materials, artwork, and product images provided by Wildfire Oil.
- Affiliates are responsible for ensuring all artwork, product images, and promotional materials remain up-to-date.
- Wildfire Oil reserves the right to request updates to artwork or product images to align with branding or product changes.
- Upon notification, affiliates must make the necessary updates within 7 calendar days. Failure to comply within this timeframe may result in suspension or termination of the affiliate account.
